Introduction and Scope

Daiichi Sankyo, Inc. ("DSI" “we” “us” “our”) is committed to protecting your privacy in accordance with the Daiichi Sankyo Group Global Privacy Policy.  This Privacy Notice explains how DSI collects, uses, discloses, stores, and otherwise processes your Personal Information ("PI") with its products, services, and websites both online and offline (collectively, the “Services”), as well as the rights and choices individuals have regarding such personal information.  DSI and its subsidiaries and affiliates will not use or share your information with anyone except as described in this Privacy Notice. 

Please read this Privacy Notice before using any DSI websites. Your use of any DSI site is subject to this Privacy Notice and the Terms of Use.  This notice applies only to DSI websites, services, and activities that display or reference this notice within the U.S.  Additionally, this Privacy Notice does not apply to individuals that DSI interacts with in an employment or contingent employment relationship.  For disclosures applicable to California residents within employment contexts, please refer to DSI’s internal Privacy Policy. 

For residents of Connecticut, Nevada, Colorado and Washington, there is a supplemental health data privacy notice below for the purposes of providing the additional disclosures necessary by the laws in those states.

Definitions

The following terms are used throughout this Privacy Notice. To the extent these definitions have a different meaning under applicable U.S. State laws where you reside, those definitions will apply:  

  • Personal Information: Information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, to you or your household.
  • Sensitive Personal Information: Social security, driver's license, state identification card, or passport number, account log-in, financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account, precise geolocation, racial or ethnic origin, religious or philosophical beliefs, union membership, contents of a consumer’s mail, email, and text messages unless the business is the intended recipient of the communication, genetic data.
  • Consumer: A resident of California, Colorado, Connecticut, Delaware, Indiana, Iowa, Montana, Oregon, Tennessee, Texas, Utah, Virginia, and New Jersey who purchases or uses a DSI product or service in a personal or household capacity.
  • Sell, Sale, or Sold: Renting, releasing, or transferring an individual’s Personal Information to a Third Party for money or other valuable consideration.
  • Share, Shared, or Sharing: Transferring an individual’s Personal Information to a Third Party for cross-context behavioral advertising or targeted advertising purposes, whether or not for money or other valuable consideration.
  • Third Party: A person or organization which is not a Consumer, Vendor, or an entity owned, controlled, or directly affiliated with DSI.
  • Vendor: A service provider, contractor, or processor which collects, stores, or otherwise handles data for DSI and is bound by certain contractual obligations consistent with applicable laws to use your Personal Information only as directed by DSI.

Categories of Individuals Whose Personal Information DSI may Collect and Use

Depending on your interactions with DSI you may fall into one or more category of individuals whose personal information DSI collects and uses.

  • Consumers - An individual (excluding Employees, Applicants, HCPs, Customers, and Contingent Workers) whose Personal Information is processed by DSI or a DSI Vendor in connection with purchasing a DSI product or enrolling in a DSI program or service.
  • Applicants – Individuals who submit applications for employment or are recruited for positions at DSI. This category includes individuals who apply directly through our website, job portals, or other recruitment channels, as well as those who are identified and contacted by our recruitment team.
  • Employees - An individual hired directly by DSI and paid through the Company’s payroll as an employee for an ongoing, indefinite period to perform work for the Company on a weekly schedule.
  • Contingent Workers - All individuals who provide some services to DSI subject to a contingency and whose work is under DSI’s direct control or supervision.
  • Customer - Any entity and its representatives or agents involved in the purchasing, prescribing or reviewing for the purchasing or prescribing of a Company product including, but not limited to, purchasing groups, hospitals, medical schools, nursing homes, pharmacies, risk and non-risk bearing payers (e.g., PBMs, HMOs, PPOs, ACOs, etc.), physician groups, integrated health systems, drug wholesalers and distributors (primary or secondary), and federal and state government entities (e.g., CMS, VA, DOD, Federal Health Insurance Exchanges, etc.). "Customer" also includes any employees or staff of such entities involved in decisions related to purchasing, prescribing or review of Company products. Please see below for additional information regarding collection and uses of Customers’ PI.
  • Health Care Professional (HCP) - All medical professionals including, but not limited to, physicians, medical students, nurses, nurse practitioners, physician assistants, pharmacists and medical technicians. “HCP” also includes other employees or staff involved in purchasing or prescribing decisions including, but not limited to, formulary and P&T committee members.  Please see below for additional information regarding collection and uses of HCPs’ PI. 

Categories of Personal Information

Depending on your interactions with DSI, we may have collected and processed the following categories of Personal Information within the preceding 12 months. :

  • Identifiers: Name, postal address, email address, phone number, social security number, driver's license number, passport number, and other similar identifiers.
  • Personal Information: Name, signature, social security number, physical characteristics, address, telephone number, passport number, driver's license or state identification card number, insurance policy number, education, employment history, bank account number, credit card number, debit card number, medical information, and health insurance information.
  • Protected Classifications: Race, color, religion, sex/gender, gender identity, sexual orientation, marital status, medical condition, military or veteran status, national origin, ancestry, disability, genetic information, and age (over 40).
  • Commercial Information: Records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.
  • Biometric Information: Fingerprints, voiceprints, and other biometric data.
  • Internet or Other Electronic Network Activity Information: Browsing history, search history, and information regarding a consumer’s interaction with an internet website, application, or advertisement.
  • Geolocation Data:  We may collect imprecise data such as a location derived from your IP address or data that indicates where you are located with less precision, such as at a city or postcode level.
  • Audio, Electronic, Visual, Thermal, Olfactory, or Similar Information: Audio recordings, electronic communications, and visual images.
  • Professional or Employment-Related Information: such as specialty, education history, professional qualifications, work history and prior employer(s).
  • Education Information: Information that is not publicly available personally identifiable information as defined in the Family Educational Rights and Privacy Act.
  • Inferences: Inferences drawn from any of the information to create a profile about a consumer reflecting the consumer’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes[1].
  • Sensitive Personal Information: Social security, driver's license, state identification card, or passport number, account log-in, financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account, precise geolocation, racial or ethnic origin, religious or philosophical beliefs, union membership, contents of a consumer’s mail, email, and text messages unless the business is the intended recipient of the communication, genetic data.
  • Legally Required Information: for example, product adverse events or Sunshine Act data.

How We Collect Your Personal Information

Depending on your interactions with DSI, DSI and its Vendors may collect your Personal Information from the following sources:

  • Directly from You: We may collect certain information from you, for example, when you participate in clinical trials or patient assistance programs, communicate with us or our employees, report quality or safety information, fill out contact forms (e.g. disease state awareness, drug information, patient assistance forms), apply for employment, or use our Services.
  • Automatically Collected Information: DSI automatically collects certain types of information whenever you interact on this site and in some e-mails are sent to you. Techniques DSI uses for this purpose may include, for example, maintenance of web server logs and placement of cookies and web beacons. DSI uses the information collected through these techniques for the following purposes:
    • After you have entered personal information into a form or data field on the site, cookies enable the site to ‘remember' that information, should you so choose.
    • Cookies and other passive information collection technologies enable us to deliver content that is tailored to your interests and preferences based on your past activity on the site.
    • Cookies and other passive information collection technologies enable DSI to compile aggregate statistics concerning use of the site, analyze trends, and otherwise administer and improve the site.
  • Other potential sources of information
    • Caregivers or other authorized individuals (e.g. legal guardians) who complete forms or submit requests on your behalf.
    • Data Brokers and providers of demographic or licensing data (for example, to verify qualifications of healthcare professionals and to perform background checks of Applicants for employment)
    • Healthcare Providers & Insurance Companies in connection with treatment, adverse event reporting, or patient assistance programs.
    • Joint Marketing Partners
    • Professional organizations with whom we interact.
    • Publications
    • Public databases
    • Social media platforms
    • Vendors and Third Parties when they share the information with us

Web Server Logs and IP Addresses

An IP address is a unique identifying number that is automatically assigned to any computer connected to the Internet. Depending on the nature of your Internet connection, the IP address may change each time you connect or may always be the same number for that computer. DSI reserves the right to log IP addresses for system administration, security, statistical analysis, demographic analysis of website use, and other functions.

Cookies

Cookies are text files that are stored on a website user's computer by the website. Cookies allow DSI to help make your web experience better and to conduct website analysis and website performance reviews. Additionally, cookies can tell DSI how and when pages in a website are visited and by how many people. Most web browsers are set up to accept cookies, although you can reset your browser to refuse all cookies or to indicate when a cookie is being sent.  Note, however, that some portions of DSI’s sites may not work properly if you refuse cookies.  In addition, DSI sites offer you the ability to accept or reject specific categories of cookies. 

Certain DSI sites may use social plugins (e.g., the Facebook "Like" button) to enable you to easily share information with others. When you visit our site, the operator of the social plugin may be able to place a cookie on your computer, enabling that operator to recognize individuals who have previously visited DSI’s site. If you are logged into the social media website (e.g., Facebook) while browsing on DSI’s website, the social plugins allow that social media website to receive information that you have visited our website. The social plugins also allow the social media website to share information about your activities on our website with other users of their social media website. For example, Facebook Social Plugins may allow Facebook to show your Likes and comments on DSI’s pages to your Facebook friends. Facebook Social Plugins also may allow you to see your friends' Facebook activity on our website. DSI does not control any of the content from the social media plugins. For more information about Facebook Social Plugins and other social media tools, and for more information about other social plugins from other social media websites, you should refer to those sites' privacy and data sharing statements.

Web Beacons

On certain web pages or e-mails, DSI may utilize a common Internet technology called a "web beacon" (also known as an "action tag" or "clear GIF technology"). Web beacons help analyze the effectiveness of websites by measuring, for example, the number of visitors to a site or how many visitors clicked on key elements of a site.

Web beacons, cookies and other tracking technologies do not automatically obtain Personal Information about you. Only if you voluntarily submit Personal Information, such as by registering or sending e-mails, can information about your use of our websites be linked to identifying information.

How We Use Your Personal Information

DSI uses the Personal Information we collect for legitimate business purposes and collects only the information necessary to achieve these business purposes, including, but not limited to:

  • Business Operations: Marketing and sales, research and development, patient support, donations and sponsorships, communications, customer relationship management, contractual obligations management, quality assurance audit management and oversight, management of event, travel, and associated expenses, providing training and support.
  • Business Administration: Finance and accounting, human resources, processing of employment applications, compliance and investigatory activities, payroll processing, and benefits management.
  • Business Management: Internal audit, asset management, system and business controls, IT security and integrity.
  • Legal Compliance: for example, reporting on aggregate spend, supporting clinical trials, preparing for regulatory submissions, and assessing and reporting on adverse events, or otherwise complying with applicable laws and regulations. 

How We Disclose Your Personal Information

DSI does not rent or sell your Personal Information to unrelated Third Parties. However, while we do not disclose personal information to third parties in exchange for monetary consideration, we may be considered to be “sharing” certain categories of Personal Information to third parties through our use of ad companies, analytics providers, and social networks (through third party tags on our Sites) to improve and measure our ad campaigns and reach users with more relevant ads and content.

We do not knowingly share or sell the Personal Information of Consumers under 16 years of age or share such information for purposes of targeted advertising.

Over the past 12 months, we may have shared your Personal Information with:

  • Subsidiaries and Affiliates: For business purposes as detailed above.
  • Third Parties and Vendors: Providing business Services to DSI or to you.
  • Joint Development or Marketing Partners: For jointly developing or marketing a product or service.
  • Government Authorities: To respond to authorized information requests or when required by law (e.g. Sunshine Act or adverse event reporting).
  • Other Situations: In connection with the sale or transfer of a product line or division, or to address security situations. 

The categories of Personal Information that we may have “shared” in the prior twelve (12) months include:  Identifiers, Financial Information, Insurance information, Commercial Information, Biometric Information, Internet or Other Network Information, Geolocation Data, Audio, Electronic, Visual and Similar Information, Professional or Employment-Related Information, Education Information, Inferences, and Sensitive Personal Information for a legitimate business purpose.

The categories of Vendors and Third Parties under the CCPA to whom we have disclosed this information are:

  • Affiliates & Vendors,
  • Regulatory authorities,
  • Internet service providers,
  • Data analytics providers,
  • Advertising networks;
  • Marketing partners;
  • Social media networks.

You have the right to opt out of such “sharing” as described under the section entitled Your Privacy Rights and Choices below.

Retention of Personal Information

DSI will retain your Personal Information for a number of years in accordance with local laws and the company's document retention policy. The length of time that DSI intends to retain each category of Personal Information, including Sensitive Personal Information, will be determined based on the criteria used to determine such period.

Your Privacy Rights and Choices

You have the right to request information about how your Personal Information is being used and with whom it is being shared. You also have the right to request to see and receive a copy of the Personal Information that DSI has about you, request its correction, or request its erasure, subject to limitations and exclusions in existing laws. To exercise these rights, please contact us as described in the “How to Contact Us” section below.

Data Subject Rights under specific U.S. State statutes

Residents of California, Colorado, Connecticut, Delaware, Indiana, Iowa, Montana, New Jersey, Oregon, Tennessee, Texas, Utah, and Virginia may have certain additional rights, subject to the limitations and exclusions in those laws or conflicting laws.

Right to Know - You have the right to know what personal information DSI  has collected about you, including the categories of personal information, the categories of sources from which the personal information is collected, the business or commercial purpose for collecting, selling, or sharing personal information, the categories of third parties to whom DSI discloses personal information, and the specific pieces of personal information DSI has collected about you.

Right to Delete - You have the right to request that DSI delete any personal information about you which the business has collected from you, subject to certain exceptions (e.g. adverse event reports).

Right to Correct Inaccurate Personal Information - You have the right to correct inaccurate personal information that DSI maintains about you.

Right to Opt-Out of Sale/Sharing (Targeted Advertising) - You have the right to opt-out from the sale or sharing of personal information by DSI by clicking on the “Cookies Settings” link on the website cookie banner of the DSI site they are visiting, or using browser settings to disable cookies.  DSI does not sell your personal information. 

Right to Limit the Use of Your Sensitive Personal Information – You also have the right to revoke consent for or limit the use of your Sensitive Personal Information to the purposes authorized by the applicable U.S. Privacy Laws, subject to certain exceptions.

Right Not to Receive Discriminatory Treatment - We do not discriminate against a consumer because of the exercise by the consumer of any of their privacy rights such as right to access, deletion or opt-out from sale or sharing of your personal information. This means that we will not, because of the exercise of consumer privacy rights granted by relevant law:

  • Deny goods or services to you
  • Charge you different prices or rates for goods or services
  • Provide you a different level or quality of goods or services
  • Suggest that you will receive a different price or rate for goods or services or a different level or quality of goods or services.

However, note that exercising certain rights may impact or completely prevent our ability to provide Services, share information, or complete contractual obligations. 

Right to Appeal - If DSI does not take action on your request, DSI will inform you without delay, and at the latest within the time period permitted for a request response, of the reasons for not taking action and any rights you may have to appeal the decision to us.

Special Note Regarding Website Use by Children

The website is neither directed at nor designed for use by children (i.e., anyone under 16 years old). DSI does not knowingly collect Personal Information from children. If you are a parent and become aware that your child has provided DSI with information, please contact DSI using the "Contact Us" link on the website, and DSI will work with you to address the issue.

Response to "Do Not Track" Signals and Similar Mechanisms

As noted above, DSI may use cookies and similar technologies to provide more relevant and personalized ads based on our users’ interests and browsing habits, and DSI does not sell or rent personal information. Certain web browsers and other programs may be used to signal your preferences to DSI about how or whether DSI or third parties may collect personally identifiable information about your online activities.  Currently, DSI does not automatically respond to such signals or mechanisms as DSI does not sell or rent personal information.  You may use your browser settings to limit cookies or select your preferences directly on DSI websites. 

Links to Other Sites

DSI’s site may provide links or references to other websites not affiliated with DSI. This Privacy Notice does not apply to such third-party sites. You should refer to the privacy policies posted on such third-party sites before using them.

Revisions to this Privacy Notice

DSI may revise this Privacy Notice at any time. Your use of the site will be subject to the Privacy Notice posted at the time of use. Please review this Privacy Notice each time you access the site.

Legal Basis for Processing Personal Data

When DSI engages in the processing of your personal data, we will only do so if this is allowed, also referred to as having a legal basis to process your personal data. The legal bases DSI would rely on include:

  • When we have a contract or agreement with you – for example, a contract to supply goods or services (i.e., when you engage with us to visit a DSI organized event, or order information online), or an employee contract.
  • When we must comply with a legal obligation – for example, when processing your data is a legal requirement, for example in some countries there are transparency requirements regarding interaction with healthcare professionals, or to provide information to authorities in case of adverse events related to use of our products.
  • When data processing is in your vital interests – for example, when this might protect your life.
  • When processing your data for our legitimate interests as a pharmaceutical company in compliance with our corporate policies – for example, to communicate with you about our products and services, about scientific research and educational opportunities, scientific and market research surveys, as well as for the effective continuation of our business operations
  • In all situations where there is no other legal basis, DSI will ask for your agreement (known as “consent”) as legal basis to process your personal data.

How We Protect Your Personal Data

We have implemented a variety of security technologies and organizational procedures to protect your personal data from unauthorized access, use, and disclosure. For example, we store your personal data on computer systems that have various types of technical and physical access controls, such as encryption. DSI has implemented data security controls consistent with industry standards; however, DSI cannot guarantee the security of your information. It is also important for you to protect against unauthorized access to your password(s) and your computer, mobile devices, etc. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of any account you might have with us has been compromised), please notify us immediately as described in the “How to Contact Us” section below.

Where We Store and Process Personal Data

As DSI is part of a multi-national organization with locations in many countries around the world, your personal information may be stored and processed in any country in which we operate, including where we have facilities, or in which we engage Vendors. DSI takes steps to process personal data according to the provisions of this Notice and the requirements of applicable law.

DSI may transfer personal data to countries outside of your country of residence. The laws of the receiving countries may not provide as stringent protections for personal data as your country of residence.  In instances where a lesser level of protection is provided by a receiving country, DSI undertakes that adequate safeguards are in place and that applicable laws and regulations are complied with in connection with such transfers.

In certain cases, DSI undertakes to enter into contractual agreements (e.g., European Union Standard Contractual Clauses), or relies on other available data transfer mechanisms that aim to provide adequate protections.

Social Networks

Generally, social networks are interactive tools that enable you to collaborate and share information. DSI may collect certain personal data from you to enable you to use online social network features. DSI may also use these tools to post or share personal data with others. When using social networks, you should be very vigilant about what personal data you choose to share with others. DSI provides notices and choices about how personal data is collected, used, and disclosed on its website, social networks, and other services. When engaging in social network activities, you should not post information about third parties without their consent.

Third-Party Services

This Notice does not address, and DSI is not responsible for, the terms of use, information, or privacy practices of any third parties, including any third party operating any site or service to which our DSI Service links. The inclusion of a link on the DSI Service does not imply our or our affiliates’ endorsement of the linked site or service.

Please note that we are not responsible for the collection, use, and disclosure policies and practices (including the data security practices) of other, non-DSI organizations, such as Facebook, Apple, Google, Microsoft, or any other app developer, app provider, social media platform provider, operating system provider, wireless service provider, or device manufacturer. If you choose to share or disclose your personal data to other organizations through, or in connection with our social media pages, you should refer to the privacy notices and terms of use provided by those organizations. DSI encourages you to review and familiarize yourself with applicable privacy settings and functions of these third-party platforms and applications.

Interactions with Healthcare Professionals (HCPs) and Customers

We may combine and use your personal information, collected from different sources, in various ways depending on your interactions with us. Here are some examples of how we use your personal information:

Learning More About You

As a pharmaceutical company, it is essential for us to understand the professional profiles of HCPs operating in our areas of research interest and disease states related to our products.  We may process your personal information to learn more about you and, in particular, to:

  • Maintain a database to identify and engage with you based on your professional expertise, opinions, and our interactions.
  • Assess your suitability for our projects based on your areas of expertise and conduct background checks to ensure we are not precluded from working with you.
  • Review your usage of our websites and/or apps, analyze the previous website you visited, the links you clicked, pages you visited, and other usage and browsing activity to understand your interests and preferences. This helps us improve our relationship with you by personalizing your experience and informing our communications with you.
  • Review your attendance at events we organize or sponsor to understand your interest in particular areas of research or clinical practice and use this information to inform our communications with you.
  • Analyze how you engage with communications we send to you (e.g., with email pixels or similar technology to determine if communications are opened) so that we can measure and improve the effectiveness of our marketing and other campaigns and inform our future communications with you.
  • Understand public perception of our products by analyzing statements about our products on external sources such as social media platforms.

Providing You with Financial Support

If we provide financial support to you to attend meetings or engage you to provide services to us, we may use your personal information to:

  • Determine your suitability to receive our support or provide services, including your expertise and other background checks to ensure we are not precluded from working with you.
  • Pay you for services you have provided and reimburse you for expenses related to those services or, where agreed in advance, in relation to attending Daiichi Sankyo or third-party meetings.
  • Manage and assess applications by your organization or by you for grants, fellowship, or travel support, including eligibility to receive support and considering potential conflicts of interest.

Engaging with You

We proactively communicate with HCPs to discuss research opportunities, product marketing, and promote events. You may also choose to get in touch with us for various reasons. Specific purposes for which we may use your personal information include:

  • Sending you product information, informing you about related services, and providing you with administrative information (e.g., sending emails with event details where you have registered to attend).
  • Arranging meetings, seminars, medical education events, and similar activities.
  • Interacting with you through online digital advisory forums.
  • Asking you to complete a survey to provide feedback, which we use to make improvements to our products and services.
  • Responding to and handling your questions or requests.

Carrying Out Research

We work with HCPs as investigators and research partners in the context of our clinical and scientific research activities. We may use your personal information to:

  • Recruit you as an investigator for a research study.
  • Conduct clinical trials and other research studies.
  • Undertake market research to obtain insights about a disease area in which Daiichi Sankyo is interested, to improve our understanding of the pharmaceutical industry, and to develop and tailor our business and services. Your responses to market research questions may be analyzed on an aggregated or individual level.

Other General Business Purposes

In addition to the activities above, we may need to use your personal information for general business purposes, including to:

  • Plan for and implement business restructuring.
  • Complete management reporting, analytics, and metrics.
  • Conduct training and ensure quality control.
  • Analyze or predict your preferences to identify general trends to develop, improve, or modify our products, services, and business activities.

Legal Compliance and Claims

We may use your personal information for legal compliance and claims purposes, including:

  • Monitoring the safety of our products, including those related to adverse events, product complaints, and safety.
  • Defending and exercising legal claims and rights.
  • Detecting, preventing, and investigating misconduct.
  • Responding to requests from competent public authorities such as data protection authorities and other regulators.
  • Fulfilling other legal obligations and regulatory requirements.

Transparency Reporting

For transparency reporting regarding the amount of direct and indirect payments, whether in cash, in kind, or otherwise, made to HCPs or for their benefit, we use your personal information: (i) to comply with national laws; (ii) for our legitimate interests; or (iii) with your consent.

Consumer Health Data Privacy Policy

This section applies to residents of Connecticut, Washington, Nevada, & Colorado.  Depending on your interactions with DSI, we may collect and process the following categories of health data for the purposes and manners described above:

Categories of Consumer Health Data

DSI and its Vendors supplying Services may collect the following categories of Consumer Health data:

  • Medical, physical, and mental health conditions we may collect in connection with recruiting for clinical trials, conducting certain types of research activities (e.g. market research), providing patient support and access programs, collecting and reporting safety and adverse events related to use of our products, and distributing and marketing our products and Services.
  • Precise location information that could reasonably indicate your attempt to acquire or receive health services or supplies.
  • Information that could identify your attempt to seek health care services.
  • Any inferences of the above categories of consumer health data derived or extrapolated from non-health information, such as cookies and other tracking technologies on our websites if you provide your express permission for our collection.

Categories of Sources of Consumer Health Data

DSI collects consumer health data from the following categories of sources:

  • Directly from You: When you share it with us through your interactions with our products and Services.
  • Through Our Websites: If you provide your express permission for the collection of your health data by us and our business partners. With your permission, we and our business partners may collect your health data over time and across different internet websites or online services when you use any internet website or online service of the regulated entity.
  • From Our Business Partners: Information provided by our Vendors who are providing Services to you.
  • From healthcare professionals – for example, reporting safety or adverse events, fulfilling REMS program requirements, or patent assistance programs.

How We Disclose Consumer Health Data

DSI does not sell your consumer health data.  DSI may share consumer health data with the following categories of third parties and affiliates:

  • DSI affiliates within the Daiichi Sankyo Group.
  • Vendors or Third parties who help administer, assist, manage or analyze our programs and Services.
  • As legally required in relevant legal proceedings and otherwise to the extent required or explicitly authorized by applicable law.
  • To other companies we collaborate with solely for activities related to products and services jointly offered or developed by us and that company.

Business Purpose for collecting, processing and sharing consumer health data

  • Patient assistance, prescription discount and reimbursement support programs.
  • To fulfill the requirements of any post-marketing safety & adverse event reporting or Risk Evaluation and Mitigation (REMS) programs mandated by the U.S. Food & Drug Administration in connection with our products.
  • Communicating information about diseases, products and services through our web sites, via e-mail, direct mail and other channels.
  • Health educational programs, publications and tools offered online and offline;
  • Marketing and advertising, such as to send you information about DSI products or related Services.
  • Auditing our programs and resources for compliance and security purposes; and
  • As required or expressly authorized by laws applicable to our business globally.

Exercising your rights under U.S. State Privacy Laws

If you request to know, correct, or delete your personal information, we may ask for details to verify your request, such as your name, email address, postal address, phone number, your interaction with DSI, and the privacy right you wish to exercise. We will respond within 45 days of receiving a verifiable request, with a possible 45-day extension if necessary. You can request this information free of charge up to twice in a 12-month period.

We may need additional information to verify your identity, which may vary based on your relationship with us. If we cannot verify your identity, we will explain why and provide steps to help verify your request. If you request deletion of your personal information, we will assess if we need to retain it for business purposes, legal obligations, or other permitted reasons. If we cannot fulfill your deletion request, we will explain why.

You may authorize an agent to submit a request on your behalf. Authorized agents must provide a copy of your signed permission authorizing the agent to submit requests on your behalf.
